Q. I have a workman's comp case that's been going on since April 10th 2023. My claim has always been denied and I never rec
A: You should make an appointment and go to see your lawyer. Or you could contact anyone of us on Justia for a free consultation. You could apply for EDD if you haven’t already done so. If you have the final report of the QME your attorney could try to settle your case for you.
Q. Can I switch lawyers? (early in the case, claim has not been filed yet)
A: You can change attorneys anytime. Once you retain a new attorney, the new attorney will send a letter to prior attorney informing him that he has taken over the representation. The prior attorney will then send the file to the new attorney. Once the case is settled, the new attorney has to share the attorney’s fees with prior attorney. Prior attorney has to prove what work he has done and based on that he will get paid by new attorney.
Q. I slipped and fell at my place of business but I had not clocked in yet. My bosses did not do an injury report
A: You can still file a Workers Compensation claim since it happened at your employer’s premises.
