After being admitted to the bar in 1989, Patrick DiChiro began his practice primarily in the areas of Criminal Defense, Domestic Relations, Civil Litigation, and Probate Law where he has obtained favorable verdicts and settlements on behalf of his clients. Q. If I am a witness for the defense can the prosecutor add me as a witness to their side?
A: The Answer to your question is yes. If you are a defense witness and the prosecutor knows about you and thinks there is something that you can add to his or her case, then they can add you to their witness list. The opposite is also true. Many times as a defense attorney, I put a witness that is a prosecution witness on my witness list. I do this because maybe there is something they can add to my defense.

Q. If someone being charged with a felony 5, will they be sent to jail on theur summons to appear date?
A: On your summons date, you will appear and a bond will be set. So, as long as you are able to post a bond, you will not be arrested.

Q. I am 25 and was stopped for speeding and had been drinking . This was my first DUI and my arraignment is in the morning
A: I always recommend pleading not Guilty. The OVI is a high level misdemeanor. A first OVI carries 6 points on your license, which will definitely affect your insurance rates. You will also get a 1-3 year license suspension. So, this is something not to take lightly. It will have an impact on your future.

There are also financial sanctions and a potential for jail.

You should consult with an attorney. If you have no job, ask to see if you qualify for a public defender.
