- Q. If parties agree on a motion, do i need a hearing?
- A: If you are trying to move your case along quickly, you should still schedule it for a hearing (with the required praecipe) to make sure the Judge will allow it. Not all Judge's will agree to waive that statutory waiting period. Also, most Judge's want to go "on the record" with these requests, particularly when parties do not have attorneys. This might also give you the opportunity to schedule the final hearing that you will need to have the Court review and sign your final Judgment of Divorce. You might want to schedule that final hearing at the same time. Every Judge is a little bit different on how they schedule those final hearings.

- Q. My husband was extradited to michigan for non payment of child support.Can he be released without prison time.
- A: Mr. Geers is correct, but I would add that it could be worthwhile to hire an attorney to review all of the documentation that might be available and review your information to see if your claims can be proven. Lawyers should have the knowledge needed to review all of the information and perhaps see things that you might not see.

- Q. My wife initiated the divorce, infidelity on her part.Am i entitled to any financial compensation.
- A: Unfortunately, infidelity in a marriage does not give you any specific right to financial compensation. Michigan is a no-fault divorce state, so anyone can get divorced for any reason. However, infidelity can be one factor in determining the distribution of the marital estate, i.e. the marital property and marital debt. It can also be one of many factors in a determination of spousal support. There are many other factors to be considered in the distribution of property and determination of spousal support, and it would certainly be considered by any attorney. You should have a consultation with an attorney as soon as possible to determine your rights.
