Q. if Drama Llama is trademarked for apparel can I use it for Lawncare services
A: Regarding the potential of trademark infringement, the general test (stated simply) is whether a member of the public would be confused between the two brands. In other words, would someone see Drama Llama the lawn care business and think that this is the same Drama Llama that sells clothes? Even though the answer is probably not, I highly recommend that you have a professional (lawyer) perform a more in depth trademark search and provide you with a more definitive answer after viewing the full landscape of what trademarks are currently being used — on the federal level, state level, and in common law.
Q. if i register a trademark, am i able to obtain the .com domain for the trademarked word?
A: No, the trademark system and domain name system are separate systems of rights and ownership.
Q. Should I still try and file this trademark? Or is it just a waste of time and money?
A: The trademark filing system is divided into Classes (groups of goods and services). It’s possible that the already registered mark may be in a different Class from yours, which could make it possible for your mark to co-exist with that registration. However, my recommendation would be to use do a professional trademark search to know with more certainty whether your proposed mark and the already registered mark would be able to do-exist.
