Andrew "Andy" J. Pascale is an accomplished Miami business lawyer with nearly a decade of experience. Mr. Pascale focuses his practice in the areas of business and commercial litigation, probate and consumer finance. Mr. Pascale routinely helps clients with the formation and sale of their business as well as with pre-lawsuit analysis, settlement demands, trial and appellate matters. Mr. Pascale's knowledge, skills and experience in the courtroom have allowed him to successfully represent clients in cases involving business torts, shareholder disputes, breaches of fiduciary duties, joint venture agreements, claims brought under The Telephone Consumer Protection Act (TCPA), The Florida Consumer Protection Practices Act (FCCPA), mortgage foreclosures, real estate partitions, and probate litigation (will contests), among others. Mr. Pascale has significant trial and appellate experience and has won dozens of consumer finance cases at trial throughout Florida. In 2014 Mr. Pascale served as lead appellate counsel in a case of of first impression that resulted in a win for the mortgage lending industry, when the Fourth District Court of Appeal agreed with Mr. Pascale that all subsequent mortgage assignees of an original first mortgage holder of a foreclosed property are entitled to the safe harbor limitation of either the lesser of twelve months of association assessments owed or one percent of the original mortgage debt. Out-of-state capital investment companies regularly rely on Mr. Pascale to counsel them in the areas of Florida consumer finance laws dealing with the enforcement of mortgage debts and regulatory compliance.
