A: What happened in the traffic court hearing does not necessarily carry over into your personal injury claim. Technically the traffic court judge didn't declare you "innocent." Instead you were found "not guilty" of the citation as charged. It may sound like a technicality, but the difference does have meaning.

In a nutshell, you need an attorney to read over the motor vehicle collision report and discuss the facts of the case with you. I would have a number of questions about what happened here before I can tell you how things should go with your situation.

A: You can't sue the insurance company if you were at-fault for the wreck that caused your injuries.

A: Surprisingly for a lot of people, "full coverage" doesn't have a real definition, but generally only includes coverage for liability, comprehensive, and collision. Unfortunately, none of these includes coverage for when the driver who causes your draft is either uninsured or underinsured.

OCGA § 33-7-11 is known as Georgia's "resident relative rule." It's a long, confusing rule, but here's the gist: legal relatives who share a residence with a person who has uninsured motorist coverage are able to use that relative's UM coverage.
