Q. Is probate filing public record ? If so, where do i find if probate has been filed and who the administrator is in CA ?

A: Locate the coun ty court where the person died, the then either ask the court clerk for the file or loook it up via internet.

Q. Co-trustee resides in property belonging to irrevocable trust. Probate section 16007 requires rent when does it start?

A: The 8 beneficiaries need to collectively hire a Probate and Trust lawyer and let him/her do what is necessary. You might be able to find one who'll wait until distribution to be paid, if all 8 of you can't pitch in on the retainer. Out of 8 people, you should be able to make a payment in good faith. You want to show a sign of good faith and keep your lawyer interested. T. Jensen

A: Having waited 4 years to assert your rights, no doubt your father thinks he can do as he wishes. You need to hire a lawyer to petition the Probate Court to compel an accounting and question why your father is taking his time to distribute. No threats to dad. Just hire an lawyer.
