Q. How can residential brokers in NYC collect fees directly from clients under the Fare Act?
A: Under New York City's Fairness in Apartment Rental Expenses (FARE) Act, effective June 14, 2025, residential brokers cannot collect fees directly from tenants unless the tenant hires the broker themselves. If a landlord hires the broker, the landlord is responsible for paying the broker's fee. This law aims to alleviate financial burdens on renters by preventing landlords from passing broker fees onto tenants.

However, tenants have the option to hire their own broker. In such cases, the tenant would be responsible for paying the broker's fee. Additionally, if a broker represents both the landlord and the tenant (a dual agent), the tenant may be charged a fee, provided the arrangement is properly disclosed.

Violating the FARE Act can result in significant penalties. For a first offense, fines can start at $750, escalating to $1,800 for a second offense, and up to $2,000 for third and subsequent violations. These fines apply to both landlords and brokers who charge tenants illegal broker fees.

If you're a tenant and believe you've been charged an illegal broker fee, you can file a complaint with the New York City Department of Consumer and Worker Protection (DCWP). They can investigate the violation and, if necessary, impose fines or other penalties.

For brokers, it's crucial to ensure compliance with the FARE Act to avoid legal repercussions. This includes verifying who hired the broker and ensuring that any fees charged are in accordance with the law.

Q. Options after 3-year ban following H2B visa expiry and delayed return.
A: If you've triggered a 3-year reentry bar by overstaying your H-2B visa and returning to your home country late, you still have options—but the path forward depends on the specifics of your overstay and immigration history.

Under U.S. immigration law, an unlawful presence of more than 180 days but less than a year triggers a 3-year bar once you leave the U.S. If you stayed longer than a year, that becomes a 10-year bar. These bars don’t apply until you depart—but once triggered, they block reentry unless you qualify for a waiver.

Here are your main options:

Wait out the bar: Once the 3-year period has passed, you may apply for a new visa, including another H-2B, if eligible. However, consulates often scrutinize past immigration violations.

Apply for a waiver (Form I-601): If you have qualifying U.S. citizen or lawful permanent resident relatives (such as a spouse or parent) who would suffer extreme hardship if you're denied reentry, you may qualify for a waiver.

Explore alternative visa options: Depending on your qualifications, you might be eligible for other nonimmigrant visas or even immigrant petitions once the bar expires—particularly if sponsored by an employer or family member.

Challenge the bar (if it was wrongly applied): Sometimes, individuals are incorrectly deemed inadmissible. Legal review of your case might uncover a misapplication of the law or eligibility for relief.

Q. Is a lien valid after judgment expiration in NY with TBE considerations?
A: This is a nuanced issue. In New York, a judgment lien generally remains enforceable for 10 years, but it must be renewed before expiration to remain valid. If the creditor fails to renew the judgment, the lien may lapse and become unenforceable against the debtor’s property.

However, when the property is owned as Tenancy by the Entirety (TBE)—which applies to married couples—additional considerations apply. A judgment against only one spouse typically cannot be enforced against property held in TBE while both spouses are alive and remain married. The lien may attach to the individual debtor’s “interest,” but enforcement is effectively stalled unless the marriage ends through death or divorce.

Even if a judgment is valid, the TBE status can shield the property from forced sale or execution. If the judgment has expired and was not renewed within the statutory period, the lien is no longer enforceable—regardless of ownership structure.
