I didn’t set out to become a divorce coach, but looking back, I realize my passion for problem-solving and helping others guided me to this promising and rewarding profession.

As a lawyer, I enjoy the intellectual challenge of untangling complex legal issues involving families, real estate, and small businesses. I find satisfaction relating to everyday problems, advocating for my clients and guiding them through challenging situations. As my kids have grown and my career as a small town attorney has evolved, I noticed that legal expertise wasn’t enough. My clients needed more than just knowledgeable legal advice – they needed support and guidance to rebuild their lives after divorce, disputes, litigation and trouble.

This evolution rekindled an interest I had as a communications major at Cornell University, and I met a local divorce coach who suggested I become certified. I started researching the field and discovered my legal background coupled with coaching techniques could truly help people transition through divorce and other conflicts in a more organized and healthy way.

A: It is hard to tell from your description of the facts, but it sounds as though your mother died without a will. If that is the case, then inheritance is governed by the Estates Powers and Trust Law § 4-1.1 Descent and distribution of a decedent's estate, which provides, "The property of a decedent not disposed of by will shall be distributed as provided in this section. In computing said distribution, debts, administration expenses and reasonable funeral expenses shall be deducted but all estate taxes shall be disregarded, except that nothing contained herein relieves a distributee from contributing to all such taxes the amounts apportioned against him or her under 2-1.8. Distribution shall then be as follows: (a) If a decedent is survived by: (1) A spouse and issue, fifty thousand dollars and one-half of the residue to the spouse, and the balance thereof to the issue by representation.

A: First of all, don't panic. I am not sure where the property or the probate court are located, but as a sole practitioner, I see this many times a year. Find a small law local firm to probate the will or administer the estate. Nothing is going to move quickly. Gather up all of the paperwork relating to her death, especially the delinquent tax bills and the death certificate. If you are in an outlying county (not NYC), you can likely enter into a payment plan with the town just to stop any foreclosure discussion.

Bottom Line-- take control, speak to an attorney and it will work out!!

A: Life estate deeds can be amended and terminated, but the process is not simple. You need the remainderman’s consent to reverse a life estate deed in New York. The same is true of making changes to the deed. This is why it’s crucial to choose your remainderman wisely. They should be someone you trust to keep your best interests and the best interests of your estate in mind.

Depending upon the language of the life estate, the "remainder men" can sue for "waste," and to terminate the tenancy, but it will require litigation.
