Q. If a motion is signed by a judge was the motion granted
A: The Order on the Motion will have the information in it regarding whether or not it has been granted or denied. You can go to the respective clerk's office in the County where the Motion was filed, and you should be able to get a copy of the Order on the Motion which will have the answer in it. It's usually pretty clear whether it was granted or denied.
Q. My husband was arrested on pending felony charges 9/14 72 days in jail No charges have been filed
A: Depending on his charge, he can hire an immigration attorney to petition the immigration court for a bond so that he can be out during the pendency of his case. But the charge may have a lot to do with whether or not the federal courts will be willing to do that. In the interim, there is no point in posting a bond on the State charge since he will just be released into ICE custody, and the County will keep the bond money until the case is resolved. You need to consult with an immigration attorney so you can discuss what options are realistically available to him. Some will argue that he is innocent until proven guilty. Just make sure you ask what the chances are, or you may be wasting the money you need to spend on a good criminal defense attorney to handle the State case, as his visa renewal, among other things, hangs in the balance. ... A: Most of this will depend on a number of items, such as whether the county you had the original citation is is going to do any type of statewide check. Even if they do, you can retain counsel, and they should be able to work out an agreement that will allow for either extending or reinstating the probation on the original ticket, particularly since the second ticket was not a moving violation, but that will be a negotiation between the prosecutor and your attorney. The prosecutor may not give your new ticket much thought as it is a parking ticket, but they may also have a show cause hearing where your attorney will need to explain why it is that you failed to comply with the original terms of your agreement on the first ticket. That is why it would be wise for you to retain someone who can work with the prosecutor and who can resolve this in your best interests before the court. ... Read More
