- A: Most of this will depend on a number of items, such as whether the county you had the original citation is is going to do any type of statewide check. Even if they do, you can retain counsel, and they should be able to work out an agreement that will allow for either extending or reinstating the probation on the original ticket, particularly since the second ticket was not a moving violation, but that will be a negotiation between the prosecutor and your attorney. The prosecutor may not give your new ticket much thought as it is a parking ticket, but they may also have a show cause hearing where your attorney will need to explain why it is that you failed to comply with the original terms of ... - Q. How long will my husband have to serve on a 6 year sentence in Texas for a non 3g offense?
- A: There is no set answer to this. Generally, we can speculate that he will serve quarter time, or a quarter of the time he was sentenced to serve if it is not a 3g offense, but that is up to the prison system and will depend on several factors. The best thing you can do for him is to get an attorney who can advocate for him when he comes up for parole. There are a number of good attorneys who are familiar with what the parole board is looking for in order to garner his release.
- Q. I have a 5 yr PO; I’d like to get out of my lease. My dad is a co-signer on my apartment; will they go after him?
- A: If your Dad is a cosigner on the lease, they can contractually pursue him for any amounts agreed to in the lease, including any attorneys' fees incurred by the complex owner(s) pursuing the damages suffered as a result of the broken lease. That stated, you should consult with a landlord tenant attorney, or perhaps an attorney who works for an organization that helps victims of domestic violence about negotiating an early release from your lease, or negotiating a settlement amount in advance.
