- Q. What can I do?
- A: You could bring a case against the school for things like negligence, violation of the basic human rights and reckless infliction of emotional distress. You could also bring cases for battery and assault.
- Q. Walmart injury
- A: This would be a premises liability case against walmart for having an unsafe condition on their property. If there was not any medical treatment it will be hard to prove any kind of substantial injury. Unless there was some kind of large cut or significant scarring, without any treatment it will likely be viewed as a nominal claim. Most attorneys will not take an injury claim where there is no corresponding medical treatment short of there being some kind of large and obviously related injury they did not require medical attention.
- Q. I stepped in a hole & fell at the Chevy dealership and severely sprained my ankle. What are our legal options?
- A: You can bring a premises liability case against the dealership/property owner. In WV, all places open to the public have a duty to keep their premises in a reasonable safe condition. However, if the hole was open and obvious you will not be able to bring a case. If the hazard, which was not open and obvious, causes injury the owner or person controlling the property can be liable.
