Q. My daughter was in an accident. The other driver was ticketed for not yielding. My daughter did not have a license.
A: I hope your daughter is doing OK. As long as it was determined that the other driver was liable for the accident, it should cover the vehicle. The insurance may try to fight you on this due to her being an unlicensed driver, but as long as that did not cause the collision, it should be responsible for the property damage and injury, if any. Please remind your daughter that it is a crime to drive without a license and also to drive without insurance. If she is a minor and you signed for her permit or you own the vehicle in which she was driving, you may be held responsible for damages should she be at fault for any other incident.
Q. Looking to speak to somebody about my wife being in a car accident..

Q. 2 cars traveling in the same direction the first car signals to turn left and then realizes he wants to turn right
A: If they’re in the same lane, the car who rear ended him is at fault for failure to maintain assured clear distance ahead.
Q. I was given a settlement due to a car accident. Today when I was called in to get my check, I was told I needed to sign
A: Yes.
Q. I had a back injury in 1997 that resulted in surgery. Now have had to have surgery again in 2019. can I reopen claim if
A: The statute of limitations for Ohio Workers' compensation claims depends somewhat on when the last activity was on the claim. You should contact a licensed attorney to discuss some specifics and they can give you a better idea of whether the claim is still active or barred due to inactivity.
Q. I fell leaving work in parking lot ( not owned by my office). Sprained ankle along with torn ligaments
A: This is a very factually specific question and cannot be answered without a further in-depth interview. I would certainly try to consult with a workers' compensation attorney.
Q. Am I liable for an back injury to my dog sitter. While on a lead my dog jerked the sitter and the sitter hurt his back.
A: Depends on the facts. If you have homeowners or renters insurance, report it to them and allow them to determine whether or not you have any sort of exposure.
Q. Is it legal for someone to kill my hunting dog if they "claim" he was after their cat but can't prove it?
A: I'm sorry to hear about your hunting dog. However, in this instance, if your animal went on to another's property, it is considered a trespass. Furthermore, under Ohio law, owners of dogs are strictly liable for any actions of their animal that leads to the injury of another. If that animal was attacking another person's property while committing that trespass, they have the ability to protect their property from being damaged. If you are trying to make a claim against that person, you would have the burden of proof to show that the killing of your animal was not justified, as opposed to the person being sued having to show that it was justified. Unless you have some other evidence other than him saying that he could not prove it, you will most likely not be successful in trying to bring that argument.
Q. I was in a car accident. Is there a reason I should hold off filing an insurance claim until after a personal injury
A: Usually, no. Typically a lawsuit only comes if you cannot resolve it with the insurance company. Filing a lawsuit costs money and if you can resolve it without incurring those costs you are in a better position. But, your circumstances may be different based on your timing. Contact a personal injury attorney and they can let you know what they feel would be a good course of action for you. Good luck!
