Legal Answers
43 Questions Answered
- Q. Concerned about school suspension for joke searches affecting future college applications and personal records.
- A: What was the joke? Until there is something on your record, it can't be "removed." If charges were brought, you should work with an attorney to seal or expunge them. If no charges were brought, there are no charges "on your record." At any rate, this is not the right forum for the kind of help you probably need, which is to speak with a local defense attorney who handles education matters.
- Q. Received eviction notice due to false accusations of suspicious activity. What are my options?
- A: An attorney would need a lot more factual information to answer this accurately and give you legal options. Contact an attorney in your local area or your local Legal Aid housing group. They will want to know what the charges are, what evidence the landlord has, what the terms of your lease are, whether you're a voucher holder subject to HUD, etc. etc.
- Q. Eviction notice for alleged lease violation in Ohio
- A: If you are a voucher holder subject to HUD conditions, there are very specific definitions in HUD leases as to when a landlord can properly evict you re having people over. HUD also has specific definitions for what constitutes a "guest" or "other person under the tenant's control." See 24 CFR Section 5 (Subsection A). If I'm misunderstanding and you aren't in subsidized housing, you should definitely still review your lease with an attorney; contact your local Legal Aid office at a minimum.
