Nick Weiss opened his practice after years of civil litigation and in-house counsel experience. A transplant from Maine, he now represents families, individuals, and businesses, throughout northeast Ohio. Q. How to proceed with stepparent adoption in Ohio?
A: A stepparent adoption with an absent parent is actually pretty straightforward. Your new spouse will need to go to your county's probate court and, with your approval, petition the court to adopt your child. The biological father is entitled to notice of the proceedings, but his consent to the adoption is not required. Your new spouse will need to undergo a background check and will be interviewed by court personnel.
Q. How to address visitation issues with my son's father in Ohio?
A: Unfortunately there is no legal way to force your ex to be a good parent. If he chooses not to exercise visitation or spend time with your son, you can't make him (outside some therapy that he also likely would refuse). You could seek a change to your parenting plan (and potentially a corresponding change in child support) to offset your ex's lack of interest.
Q. Ex violating divorce decree by withholding bonus payment.
A: Thirty days from receipt of payment is pretty standard. Is he in violation of the decree? Probably. Should you take legal action until after April? Probably not. Once that timeline has passed if he still hasn't paid then your daughter should consider filing a motion to show cause.
