- Q. How can I recover belongings from a friend's house in SC?
- A: I don't have criminal law experience, but a civil lawsuit would not be well suited to solve this problem. It is a lengthy process designed for a harmed person to recover damages, not to force your friend to return your property. The police may be able to help in the short term, but it probably depends on her specific conduct.
- Q. Can insurance decide fault if other driver ticketed?
- A: An insurance company may take the position that its insured is not at fault for a collision even where the insured was ticketed. Neither the police officer who investigated the collision nor any insurance adjuster has the final say on liability. If you were injured and suffered damages in the collision and the insurance company is refusing to accept responsibility, you should speak with a personal injury attorney. You may have to file a lawsuit, but if you have compelling arguments regarding the other driver being at fault, it will give you the opportunity to recover for your losses.
- Q. Can endometriosis misdiagnosis leading to severe complications justify negligence?
- A: Yes, there could be a claim in this situation, but it depends on many factors. If there is a case here, it would be a medical malpractice case, which requires a physician review of all medical records before any case can be initiated.
