Donald Paul Fitzgerald III
Don Fitzgerald practices in the area of commercial and consumer litigation. Don focusses on the rights of consumers who have been subjected to unfair credit reporting, harassment from debt collectors, and foreclosure on their homes. Don aggressively fights for consumers’ rights using the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Florida Consumer Collections Practices Act, Florida Unfair and Deceptive Trade Practices Act, and other laws that provide relief for beleaguered consumers.
Don attended college at the Massachusetts Maritime Academy, an internationally recognized training school for Merchant Marine and Naval Officers, and attended law school at the University of Florida Levin College of Law. There he was a teaching assistant in legal research and writing, a tutor for contract law, and received a book award for property law.
Don began his legal career as a summer associate and litigator with the highly respected AMLAW 200 firm Shutts & Bowen in Miami. Moving to the corporate world, Don served as General Counsel of OSI Portfolio Services in Atlanta, where he oversaw corporate litigation, advised senior management on all manner of legal issues, and negotiated a very wide variety of contracts and agreements.
Today Don represents consumers who face abuses from unscrupulous corporate actors, and also represents many various businesses in transactional and litigation matters. His broad experience at both the consumer and corporate levels enables him to analyze his clients’ problems and to foresee their legal challenges, and then to develop practical, logical and pragmatic options for moving forward, whether it be litigation, negotiation, or another path.
Don is admitted to practice in Florida and Georgia, and before the U.S. District Courts for the Southern and Middle Districts of Florida, and the U.S. Court of Appeals for the Eleventh Circuit in Atlanta.
Don lives with his wife and two sons in Palmetto Bay, Florida.
