- A: Technically, this is child support, but whether you will be able to increase that amount to cover college as well depends in part on whether the original child support was part of a divorce settlement or not. One within them need to look at whether the divorce settlement addressed college or waive those costs. If the child support was just part of an original Family Court support order and you’re still under 21 then most likely your mother petition to include a share of college Call a child support attorney in your county to schedule a consultation for a full assessment.
- Q. How can I enforce a visitation agreement in NY if the mother keeps breaking it and my daughter is burdened with responsibilities?
- A: If you have a specific court order granting you access for this summer, you should file a Violation petition. If your current order is not that specific, then you should file a Modification Petition. You can include in your Modification Petition that you're looking for primary residential custody, or alternatively a more specific parental access schedule. - Q. Do I need to share evidence with my ex's lawyer in a child custody case?
- A: Text messages are a form of evidence which could potentially be entered into evidence at trial. I do not recommend merely "brining them to court." Instead, I recommend communicating with opposing counsel stating you have no issue sharing such evidence - with the proviso it's reciprocal. Further, I recommend to serve them via Notice to Admit. Finally, if the Father is represented & you are not, then I highly recommend asking the Court to assign you a lawyer, or hiring one. You'll be at a severe disadvantage if you try to litigate such an important case on your own.
