Attorney David Bliven graduated with honors from Syracuse University in 1993 with a B.A. in Sociology. He went on to serve as a judicial intern and statistician with the NYS Commission on City Court Judicial Reallocation with the Office of the Deputy Chief Administrative Judge.
David Bliven then attended law school at New York Law School, where he graduated with honors and ranked within the top 15% of his class.
He then worked in private practice for a year, doing mostly matrimonial work, before serving as a prosecutor for nearly 3 years with the NYC Administration for Children's Services. There he prosecuted child support, child abuse/neglect and foster care cases on behalf of the City of New York.
After leaving the prosecutor position, Mr. Bliven opened his present practice in 2000. His philosophy is to provide quality legal representation at affordable prices. His practice is approximately 99% divorce & Family Court cases, along with 1-2% police/governmental misconduct cases.

- Q. How can I transfer a family case from Brooklyn to Westchester, NY, where my child and I reside?
- A: When you say "There are no existing custody or support arrangements in Brooklyn to consider," I assume you mean there are no court orders addressing those issues. If there's pending cases on such issues, then it may depend on how far along those cases are. If there are no prior court orders & no pending cases, then simply file a Petition in Westchester. - Q. Ex-husband refuses to leave my property post-divorce; what are my legal options?
- A: Did your divorce judgment grant you exclusive occupancy? Did it require him to leave within a certain amount of time? Regardless, you may need to send him a notice of removal - requesting he vacate within 30 days. if he still doesn't move-out, then you may need to file an order to show cause requesting a court order of removal. - Q. In New York, how often and under what circumstances can a child support be modified?
- A: The statute (FCA 451(3)(b)) simply states child support is modifiable - among other reasons - once every 3 years from when the order was "entered, last modified or adjusted." Implicitly, this means any aspect of the order. This doesn't mean the order from 2021 cannot be adjusted in 2023, however. The statute goes on to state that child support may be modified if the noncustodial parent's income has gone up by 15% of more. If you suspect it has, then you can retain counsel & have him/her send a subpoena to the noncustodial parent's job (if s/he doesn't voluntarily produce their income info) to obtain their W-2.
