Barbara Ungar

Barbara Ungar is a solo practitioner with 32 years experience and 21 years
experience in private practice. Ms. Ungar has extensive criminal defense, DWI, DUI, municipal court defense, family court litigation experience and appellate experience before the Appellate Division. She also has extensive experience with estate and probate litigation, will contests, guardianship proceedings and residential landlord tenant litigation.

She formerly served as an Assistant Essex County Counsel from 1988 through 1990 with expertise in mental health and hospital law. Ms. Ungar then served as a Deputy Attorney General with the Division of Criminal Justice from 1990 through 1999 with expertise in complex narcotics and environmental civil forfeiture and white collar, labor and fraud prosecutions.

Ms. Ungar was involved in the New Jersey Supreme Court case of State v. Denselbeck involving jury trial rights for third and subsequent DWI offenses. Ms. Ungar argued before the Appellate Division as counsel for the Defendant and the Appellate Division issued an unpublished decision of State v. Brian Gundy, affirming PTI admission for an individual charged with a gun offense. Ms. Ungar also argued before the Appellate Division as counsel for the Defendant and the Appellate Division issued an unpublished decision in State v. Joseph Blanc, remanding the issue of PTI admission back to the trial court.

Ms. Ungar is the past Chair of the Municipal Court Practice Section of the New Jersey State Bar Association. Ms. Ungar is also the past Chair of the Criminal Law Section of the New Jersey State Bar Association. Ms. Ungar is the current trustee of the Women in the Profession Section and the Solo and Small Firm Section of the New Jersey State Bar Association. Ms. Ungar is a member of the National Association of Criminal Defense Lawyers, the New Jersey Association for Justice, New Jersey Women Lawyers, Middlesex County Bar Association and the Edison Chamber of Commerce.

Q. Trying to expunge my record from 1989 for drug paraphernalia. Do I qualify and if so what do I need to do?

A: The new marijuana bill provides for the recreational use of marijuana under 6 ounces and paraphernalia. As a result of the new marijuana bill, the Attorney General issued a directive mandating the dismissal of all pending marijuana charges and vacating all prior convictions for marijuana. Your prior paraphernalia conviction would come under that law and may not require an expungement to be filed. An application to the court for vacating that charge can be filed. If you prefer to seek an expungement of the arrest and charge you would qualify and it's a simple process. You should consult an attorney who handles these type of matters to prepare the documents for you.

Q. Was given a summon for this statute; any way to not show up to court just to plea guilty and pay fine?

A: The municipal courts are now operating on zoom. You should plead not guilty and the Court will schedule you to have an opportunity to speak to the prosecutor. You do not have to appear in person in court as all court proceedings are remote. I would recommend given the nature of the violation that you consult with an attorney so you can achieve the best result.

Q. Landlord gave us a letter on March 1st stating he's doing a 30-Day quick deed sale on the house we are renting

A: Presently, there is a stay of evictions signed by Governor Murphy under Executive Order 106 on March 19, 2020 as a result of the pandemic. The stay of evictions was recently extended by Governor Murphy and also by the federal government under the Biden administration. The CDC guidelines reference evictions not being permitted but it is not controlling legally. The Executive Orders of Governor Murphy staying evictions in New Jersey governs and the landlord can not evict you. Even though they sent notice seeking to sell the property, they can not lawfully evict you. In addition, if they have accepted the payment of rent from you this month, that is another basis for you to remain in the premises lawfully. You can retain an attorney to send the landlord a letter advising them of the law and advising them of their actions being against the Executive Orders of Governor Murphy. ... Read More
