If you're looking for local protection, then I recommend contacting a Florida-licensed attorney for guidance. If you want a federal registration instead, then you should start by conducting a preliminary search using the U.S. Patent and Trademark Office's online search tool, TESS. You can review both pending applications and registered trademarks on TESS, though international filings or very recent applications may not always be immediately visible. While this type of search isn’t a comprehensive clearance search, it’s a good first step before investing time and resources into building a brand.

The next step is to either consult a trademark attorney to assist you with the application process or attempt to file on your own. As the previous comment mentioned though, it's not a good idea to try and do this yourself if you don't know what you're doing. In my experience, individuals who try to navigate the process without an attorney often make mistakes that can be costly, or sometimes impossible, to fix. Often, by the time I get the call, the damage is already done, and we have to go back to square one anyways.
