Todd B. Kotler
Arnold, Gruber & Haren, Ltd.
Since 1999 I have labored to establish divorce settlements that are firm but fair and parenting-time schedules that work. Relocating and long-distance parenting plans. I resolve high-conflict situations, protective orders, and deal with parental alienation. I also have litigated a number of high value cases in both Summit and Stark Counties.
My firm also has handled a great number of high value transactions involving mineral rights, land leases and easements with energy companies. We have done joint ventures, partnerships, S corporations, LLCs, commercial and industrial developments, condominium developments or conversions and office building sales and purchases. Likewise, I have drafted construction contracts, lease negotiation and preparations, loan workouts and foreclosures as well as sale and purchase contracts.
Notably, I am among a handful of Ohio Attorneys who practice special education law. My focus in this area is on the parents of special needs children. I aid them in ensuring that these children receive the free and appropriate public education (FAPE) that each child is guaranteed under state and federal law.

- Q. I had a stroke last year which affected my ability to speak. , my school is threatening to terminate me, can they ?
- A: You should review your contract and your collective bargaining agreement. Have you contacted your union rep? Whether they can terminate you will depend on the language on the agreements. Do either mention clarity of speech as a physical requirement for your job? You also may want to contemplate a complaint to the EEOC if a negative action is taken against you.
- Q. In OH marriage can debts obtained by one person affect the other and...
- A: Debts incurred during the marriage are presumptively marital debts. Parties may agree to treat them differently or in the case of a divorce a party that did not incur the debt may make an argument as to why it should be treated as a separate debt. Factors may include the circumstances around the incursion, the beneficiaries or purpose of the debt, and whether some third party was enriched.
- Q. In OH, can you keep property obtained in marriage fully separate, to do as you want with it without involvemen of spouse
- A: In Ohio you can now enter into postnuptial agreements to treat property separately. There are conditions, however. The full values of all property by both spouses must be fully disclosed and the spouse must both have the benefit of independent counsel. There still is the issue of dower as well that the non owning spouse must waive in the event of a sale or the death of the spouse that owns the property
