- Q. Which form to file for custody order: FL-260 or FL-300?
- A: If you do not have any existing/open case related to custody you need to file an initial petition. That can be a Petition under FL260, or a Petition to Establish Parental Relationship (aka paternity or parentage) - FL200. The Petition opens your case and you are assigned a case number. You can then get temporary orders, while that case is pending (and you do not yet have a final judgment). You get those orders by filing a Request for Order (FL300). You can file your FL300 with your FL260 or FL200. If there is no existing case related to the custody of your minor children, you cannot simply file a FL300 for custody/visitation just because you have an open child support case. Child support ... - Q. How does being a stay-at-home mom affect divorce process in CA?
- A: It will influence your entitlement (duration and amount) to spousal support. If there are minor children involved, it may also impact child support and may even influence what type of parenting plan (aka custody) arrangement you can ask for. To maximize what you are entitled to, I strongly recommend you hire an attorney. Divorce is not a DIY project. If you think you cannot afford an attorney, your attorney can file a motion with the court asking for an order that your spouse contribute to or cover your legal fees and court costs.
- Q. Can I file for both annulment and divorce in California using form FL-100, after failed annulment in Nevada?
- A: You already have an open case in Nevada with a default pending. Why would you file another case in California? Why would you file for divorce when you believe your marriage is void and thus filed for nullity in Nevada? Your marriage was either valid or it was not. If your spouse was married to someone else at the time of your marriage to each other, then your marriage is void; period. If your Nevada case gets dismissed, it's only under that circumstance that you'd be able to then file for nullity (or divorce) here in CA.
