Biography

Attorney Thomas Fleming graduated from Yale Law School and UC Berkeley; taught as an Adjunct Professor of Law at Law School; taught criminal trial skills, in DUI and criminal cases, to future prosecutors and defense attorneys; and taught UC Berkeley undergraduate law classes about the U.S. Constitution, the courts and politics for over 20 years.

Thomas also served the community, in DUI and criminal cases, for over two decades as a Trial Attorney with the Public Defender. He successfully took many, many cases to jury trials, and developed a very special expertise in defending against DUI and criminal charges.

Thomas earned a reputation for consistently winning very excellent results for his clients in DUI and Criminal cases.

It is quite traumatic to face the serious consequences of a potential DUI or criminal conviction. Thomas' combination of (1) academic knowledge of the law, (2) his excellent record in defending against DUI and criminal charges, and (3) his background of spirituality, non-judgement, honesty and his sense of mercy and compassion -- all make an extremely persuasive and effective advocate.

He cannot take every case but invites you to contact him for a free consultation.

2 Questions Answered
Q. Been inquiring about the ability to reopen a case I plead guilty to 5 years ago. I was not11 guilty. Advised by P defend
A: I'm sorry you've going through all this. Since the public defender represented you, start there and ask another attorney to take a second look at this. If you received ineffective assistance of counsel, for example, then you may be entitled to a new trial. If that is the case, however, the public defender will conflict out of the case, and you might have the court appoint private counsel for you (or the Alternate Defender's Office if your county has such an office). I wish you the very best with your situation!
Q. If I bring my prescription into court on my court date will the judge verify that it is actually mine
A: I’m not sure why you want to bring in prescription medication into court but I will presume it is to provide evidence of legal possession (versus illegal possession) of a drug. This can be a very perilous act, and can backfire in many different ways. Please first consult with your lawyer (or if you don’t have an attorney, either retain one or request a public defender attorney) before doing any action like this. He or she can explain all the specific pitfalls of taking such an action in the context of your case and the particular charges you may be facing.
