I am a CPA and attorney. I have been a CPA since 1994 and an Louisiana attorney since 2000. The Louisiana Board of Legal Specialization has designated me as a Board Certified Estate Planning and Administration Specialist (since 2008), as well as a Board Certified Tax Law Specialist (also since 2008).
My practice focuses strongly on the needs and issues particular to farmers, middle income clients and small business owners. These include issues such as estate tax reduction, medicaid long-term care planning, special needs planning, asset protection planning, and small business protection planning.
Plans I regularly recommend and personally draft for my clients include tax reduction trusts, revocable trusts, irrevocable trusts (for long term care qualification), special needs trusts, probate avoidance plans, last wills and testaments, asset protection trusts, litigation avoidance plans, charitable trusts, income and estate tax savings plans, and various legal entities such as limited liability companies (LLCs) and S corporations. I also have a steady probate practice.
I regularly qualify clients for medicaid long-term care benefits who have not engaged me for pre-planning and who find themselves having to go into a nursing home. For these clients, I regularly achieve savings in excess of 50%+ off their nursing home costs, even though these same clients are routinely told by others that they have to spend down their assets to $2,000 or less.

- Q. Ex died leaving a house he received in divorce to his sister. Im still on the mortgage. Who pays and what happens to
- A: I assume there is no cash in the estate.
Are you and his sister adversarial? If not, then talk to an attorney about working out an agreement that allows you to be recognized as a creditor of the estate, and pursuant to this agreement you would ontinue pay the mortgage, but you would get your payments reimbursed out of any sales proceeds from the sale in preference to any other payments. This could be its own mortgage. You would have a second mortgage and be reimbursed at closing like the first mortgage company.
If you are adversarial, you may have to obtain an order from the court pretty much doing the same thing, but you would have to go in for a hearing before the judge.

Your attorney should be able to get this for you if you don't understand the online menu.
You will also likely have to provide the bank with a certified copy of the Order or Letters of Administration authorizing you to act for the estate.
- Q. A will was drawn up by an attorney who allowed a felon to be an executor Is he liable ?
- A: Probably not. An attorney that drafts a legal document for a client needs to put down what the clients wishes are in the document, but does not have a legal obligation to make sure the people listed by the client are appropriate choices.
On another note, many states have a statute that provides that a convicted felon cannot serve as an executor. At least mine does. Under the laws of such states, that executor can be removed from office by the judge. You may want to approach a lawyer to find out if your state has a similar law.
