Q. NOID 4 years ago and when I called the Immigration Courts nothing came up!
A: I am sure that calling court hotline has nothing to do with receiving NOID for your pending green card based on marriage case. The NOID is not a final decision to deny its just an intent ( warning) that your case may be denied if you don't provide documents requested by the NOID. If your marriage is still valid, make your best effort to provide as many documents as possible regarding your marriage in reply to the NOID and there is a good change that your case will be approved.
Q. can I travel with the passport from my country of origin as a green card holder through asylum to other countries?
A: Yes you can travel with passport and green card ( you don't need refugee travel document if you have a passport from your country).
Q. switching from S-Corp to LLC under E2 visa
A: Hi there! Changing your company's tax status from s corp to LLC will not affect your immigration status. Just make sure that your ownership in the company does not change.
Q. Is my name an issue?
A: Use your US legal name for the purpose of petition for your wife. Include all previously used names on the application form ( application will ask yuh for that information). Good luck!
Q. I got married after the N400 interview but before oath ceremony
A: Don't be nervous, your travel and marriage should not affect your oath ceremony, just disclose it truthfully on the application form that you should fill out before your ceremony. Congratulation on your upcoming naturalization!
Q. When does USCIS sent out REF for I-751?
A: Hi there, if you are planning to file I-751 by yourself requesting that the joint filing requirement be waived based on good faith marriage exception, you will have to submit documents in support showing that your marriage was a bona fide ( real marriage) and a copy of your divorce decree. So to expedite the process of adjudication of I-751, you can file now while your divorce is filed and pending ( attach a copy of the divorce filings) and then eventually USCIS will request a final decree of divorce to finalize adjudication of your I-751 petition ( since you are not eligible for a fona fide marriage exception unless you have a final divorce decree). Q. I filed F2A-LPR spouse (Philippines) PD: Nov 6,2018.
A: Since you filed an old version of the I-130 application, most likely they will reject ( not deny) your case. They will return your application and filing fees and will instruct you to re-file using current version of I-130.
Q. Can I reapply for adjustment of status with my husband?
A: Yes, since you are back together, your husband should refile I-130. Make sure to collect all the documents showing that your marriage is bona fide for your interview - including evidence of marriage counseling. Good luck!
Q. can I go ahead and marry my GF.
A: Hi you can not change status since you are in removal proceedings with the immigration court. You should marry your GF and ask her to file family based petition for you. At your next Master Hearing with the court, file your asylum application and tell the judge that you are now married and your family based petition is pending. Upon approval of your petition, you can ask court to adjudicate your application for adjustment of status( green card application). This is all provided your GF is a US citizen. If she is a green card holder your strategy should be slightly different. In any event, it is advisible for you to retain an experienced immigration attorney. Good luck!
