- Q. If I have a family court order that says my fiancé and I can be together does that supersede county court like criminal?
- A: If a criminal court has issued an Temporary or Permanent Order of Protection, then you will need to see if that Order of Protection can be modified by a subsequent order of the Family Court. It is usually either written or "checked" on the Order of Protection. If the Order of Protection does not indicate that it can be modified by a Family Court order, then you may need to return to the court in order to protect yourself. A violation of an Order of Protection can result in additional criminal charges, so it's best to be sure.
- Q. I was charged with riot 2nd and assault 2nd. I was arrested with no Miranda rights read to me
- A: You are charged with very serious felony crimes and need to represented by an experienced criminal defense attorney. That said, the fact that you were not read your Miranda rights will not invalidate your arrest. Miranda rights are necessary if the police question/interrogate you while you are in custody. Again, you should consult with a lawyer.
- Q. Are there defenses for the NYC emergency curfew if arrested?
- A: Yes there are defenses available to individuals arrested under the curfew. As with any case, the defense would depend on the specific circumstances of your case and arrest. The New York DAs have already indicated an unwillingness to prosecute certain types of cases. However, you should consult with an attorney to review your particular case.
