Since May of 1984, I have been helping people in trouble with criminal law problems, DUI/DWI problems, and family law problems. I am licensed in State and Federal Court, and by the U.S. Supreme Court. I will see a person with a problem in any one of these areas, usually, on the same day as I am contacted. My fees are charged based on the seriousness of the problem, what needs to be done, and taking into account the person's ability to pay. My consultations are free, with no obligation, and will take as much time as necessary to determine the best path forward to a successful resolution.

Q. My gf brother is using illegal drugs in my house and won’t stop also has threatened to kill us if we got in the way
A: So many questions for a seemingly simple situation. Assuming this is an adult, non-household resident, not living there with your GF, and your GF doesn't approve of his drug use; call the sheriff or local police agency so that they can assist you in removing this person and hear any threats he might make. If he is sharing the residence and receives mail there or has a written agreement with you regarding his living there, sharing with the expenses and is otherwise a "tenant," then you might have to evict him through the court system. JP Court is pretty user friendly in this regard, even without a written lease. Then there is the complication of his threatening to "kill" you part, which, depending on when it was made and how serious you felt it was as a legitimate threat of SBI, that may be a Texas Penal Code violation in and of itself, and subject the person to arrest. I am supposing that your GF is supportive of your position and doesn't want her brother using drugs and making threats, as well, so my remarks were made with that thought in mind. A: I think you need to explore your situation with a lawyer that practices civil rights law. The criminal aspect of what happened is apparently concluded & I'm assuming you had a lawyer representing you to whom you posed these questions. Your overall question is somewhat confusing because you say they changed your name in prison, you were lost for 6 months, it would seem b/c of this, but then you say you were paroled before you ever got to prison. Are you on parole now, with all other charges dropped, or what is exactly your present situation? The situation you describe makes me think lawyer's & judge's committed misconduct, if you were actually innocent, and a writ of habeas corpus if you are on parole, but I don't have enough facts about the situation to further comment. Q. What is the punishment for a stolen firearm in texas first offense
A: Firearm theft in Texas is different than other theft classifications that are graduated by value of the item taken or if livestock, e.g., & states at the penalty level of a State Jail Felony. That range of punishment is 180 days to 2 years & up to a $10,000.00 fine. Community Supervision is available, either regular or deferred adjudication, depending on a person's criminal history.
