Biography

Spencer has practiced exclusively in family and domestic relations law for over twenty years as a counselor of law and aggressive litigator for hundreds of clients. He has helped his client’s find success in cases ranging from complex financial and high conflict custody disputes to settled family law matters.

Q. what does it mean when you can have one week that doesnt exceed 10 overnights when attached to regular scheduled time?
A: Typically this would be a part of a summer vacation schedule and I am assuming that the normal schedule consists of an alternating weekend schedule.

A parent can designate a seven day period and attach that to their weekend at the start or end of the one week vacation period thereby giving ten consecutive overnights of custody. However, someone could not attach to a another period of time such as a holiday that would give their regular weekend, the one week vacation period plus the holiday/special day such that the consecutive overnights would be more than ten overnights.
Q. we live in mo. our daughter was murdered in 2020. we were awarded guardianship. father unfit. how can we get their child
A: The most economical option would be to discuss the issue with the Family Support Division and see if they can file to establish or modify the support order to direct to you. If they are unable to help you can file a Petition for Third Party Custody and Support with the County in which the child resides. This can also provide a more permanent custody arrangement for you and your grandchildren as once established it more difficult to modify a Custody Judgment compared to a Guardianship Order.
Q. Which parent is responsible for school morning drop off in this scenario?
A: From the description you would be the receiving parent. All the time in a given day needs to be accounted for between each parent (the school is not a custodian of your child) so as the start of school or as of 8:00 am the children are back in your custody. A common discussion is if a child gets sick at school which parent is responsible for pick up. I would suggest exploring a modification (I would suggest you attempt to mediate this relatively small issue before filing in court) to change the language for father’s time to end by returning the child(ren) to school or if there is no school at 8:00 am.
