Summary

Atty. Janaan Hashim focuses her criminal law practice exclusively on expungements and sealing of records and other forms of post-conviction relief.

Since graduating from law school Janaan has always worked in the criminal justice field, first as an Assistant Appellate Defender with the State of Illinois and then in private practice at the trial level until shifting her focus on expugements in 2015.

Janaan volunteers her time and legal expertise at Cabrini Green Legal Aid where she assists pro bono petitioners with both their Expungement and Sealing of Records petitions and court representation when the State objects to their petitions.

Janaan's other passion is in mediation. She has completed two coures to qualify her as a mediator - the first course through the Illinois State Bar Assn and the other through Northwestern University. The latter training addressed specifically Divorce Mediation.

Outside of the office Janaan serves as a board member of the Mary Baldwin Alumni Association and is an adjunct professor at McCormick Theological Seminary. Janaan relaxes through gardening, putting in a good workout at the gym, and going for walks with her husband. Janaan will also never say no to a good book or to a good hike.

10 Questions Answered

Q. can you get sued for defamation of character if you post something and you don't use the persons name at all?
A: The elements of successfully proving a defamation of character tort in Illinois are the following: (1) the defendant made a false statement about the plaintiff; (2) there was an unprivileged publication to a third party; (3) fault by the defendant amounting to at least negligence; and (4) the publication damaged the plaintiff. Where the defendant does not state the plaintiff's name, Illinois case law states that the plaintiff must allege and prove that third-parties would reasonably have understood that the libel referred to the plaintiff. Good luck.
Q. Is it possible for a member of society to read a criminal indictment against the accused defense? If so how ?
A: They would have to ask the clerk where the charges were filed for the case file. The case file will have the indictment available for review.
Q. Can I sue county for time spent in jail?
A: Based on what you provided, if they arrested you properly and you were proper arraigned and unable to post bail, then any success in filing unlawful arrest would be difficult.
Q. Can a person that's found guilty of a crime get the actual perpetrator to testify and free him completely
A: Yes, it’s possible, but it would be an uphill battle with the Starw. It would be best to hire an appellate lawyer to draft and file the proper documents and to make your case. Good luck.
Q. I went to police with 2 bruises on the weekend. They said I have to file charges Monday. I am not going back there
A: If you haven’t filed any charges, then there’s nothing to be dropped and no need to tell the police anything. But, the guy at whom you threw the plate could press charges against you on his own initiative. Good luck.
Q. My employer (a DVM) has done some illegal things. If I quit because I’m uncomfortable, could I get unemployment?
A: Unemployment comes when you are fired, not when you leave. Good luck.
Q. If someone goes to jail and is proven innocent, does the accusation get erased from their record?
A: No, the accusation does not get erased from their record. Their arrest record remains in public view and a matter of public record until the person arrested takes steps to have their record expunged. Good luck.
Q. How am I able to find recollection of complaints or district on several officers?
A: Chicagocopa.org may have information on the officer if the officer was subject to a complaint. Good luck.
Q. my 16-year-old got detained For matching Description of a call-in saying she was trying to break into cars
A: The best thing to do is to either hire an attorney or to use the PD if you cannot hire an attorney. The attorney will do his/her best to get the charges dropped. Good luck.
