Biography

After thirty years of practice in NY, my wife, Shelley, and I moved to Boca Raton, FL (NY with FL weather). In addition to creating, editing and publishing CasePrepPlus.com, a comprehensive paid subscription online annotated advance sheet service for the NY Bar from 2006 to 2014, which is now published by NYSBA as a member benefit, I continued providing consultations and drafting motions and appeals for a few of my colleagues back in NY, and handled first party PD hurricane and tropical storm claims, private LTD and group ERISA claims, and general legal matters as a member of the FL Bar. Now, having moved to the "Valley of the Sun," Phoenix, AZ in 2018, I am limiting my practice to those lawyers who can't find the time to draft "heavier paper" (significant motions, briefs, appeals) and trial prep.

I know how challenging it is for solos and small firms in today's "time of the essence" computer litigation schedules to do everything that's needed. And even larger firms can use another set of eyes to review a brief as a "first read" to make sure that it is readily understandable to a judge, or his or her law secretary, who doesn't know what you know about your case and who is inundated with other cases.

My services are confidential, unless you want my name listed "Of Counsel" with your firm as the attorney of record. I also avoid actual or potential conflicts of interest in anything that I undertake.

I am not operating a "service" whereby your matter will be "farmed out" or given to an underling, which is common in today's legal sourcing industry. Rather, I personally will review your underlying documents, research points of law, and draft what is needed. You deserve nothing less.

Q. Is it legal to accept money from a sale of a home if a notary falsified witnessing a signature on a deed?
A: Depends on the law in each state. However, accepting cash is legal. The problem is whether the deed can be filed, which serves as notice to the world that the person who paid cash for the property is the true owner. The deed should be corrected pursuant to the terms of the written contract of sale. A lawyer will be needed for this if the seller and notary won't cooperate and re-execute the deed.
Q. Do I have a case for false arrest & maliceous Prosecution?I was accused of commiting a crime and it got dimissed on 3030
A: Depends on who made the criminal complaint, and whether it was false and done with malice. Any lawyer you consult will need far more facts that you have provided.
Q. I’m looking to have a revival or waiver of a statue of limitation and I have some questions. Hope you can help.
A: There is no question to answer.

Revivals of causes of action are by statute. They are few and far between in NY; they are remedial legislation.

The waiver of a statute of limitations is rare, but does happen. These waivers are based upon an equitable principle whereby the defendant is estopped from asserting the defense because of misleading the plaintiff into delaying the commencement of an action. It also can be deemed waived if a defendant does not assert it as an affirmative defense in the answer to the complaint.
