Biography

Richard Diamond has been practicing Family Law Litigation, Mediation & Arbitration work in New Jersey for the past 37 years and is a Certified Family Law Trial Attorney by the N.J. Supreme Court; Accredited New Jersey Family Law Mediator, authorized by the NJ Supreme Court to handle family law mediation matters with an active domestic violence restraining order in place and a Family Law Arbitrator.
Mr Diamond is also a Family Law Economic Mediator in Union, Essex, Morris, Somerset, Middlesex and Monmouth Counties.
Mr Diamond is also a member of the Essex, Union and Somerset County's Family Law Early Settlement Panel Program (ESP); a member of Who's Who in American Law; listed in Best Lawyers in America and a recipient of the Albert Nelson Marquis Lifetime Achievement Award for Family Law accomplishments.

Q. Can a simple assault domestic violence charge be dropped?
A: I'm guessing you / your partner was criminally charged with simple assault through the police department, AND there was a domestic violence complaint filed as well through the municipal court judge or superior court judge sitting in the family part.

If my understanding is correct as to the filing of a criminal charge of assault, the "victim" has the right to approach the municipal / county prosecutor handling the criminal complaint and ask to dismiss the complaint. Since im guessing there was also a domestic violence complaint filed, im sure that the prosecutor is going to want to know whether that matter is being dismissed and what protections are going to be in place moving forward. If my understanding of the setting is correct, presume that the prosecutor and judge will want specific information from the victim before they wiil simply dismiss the matter to ensure that it will not take place again. ... Q. Can I sue for breach of confidentiality for a child abuse report in NJ?
A: As a general statement, when someone makes a claim of child abuse to DCPP, it is viewed as confidential. I'm not sure what occurred in your setting and whether the DCPP rep actually told your son that you had reported him, or if your son guessed the reporting came from you and you then confirmed it (ie he told you that the DCPP rep told him that you were the one who reported it and you then admitted it to him). But the bigger issue is governmental immunity and rest assured that the DCPP rep's notes will reflect that you were asked about confidentiality and their notes reflect that you waived same. So from a litigation standpoint, you may be able to find a law firm willing to take on your matter but the prospects of success are not good.

On to the biggest issue outstanding, your son and your relationship with him. You reported him to DCPP for potential child abuse - and presumably, you had good reason to do so. Since its now out in the open, maybe this is where you need to sit down with him or with other family members to talk about your concerns in a way designed to assist your son and / or provide your grandchild with needed protections.

Q. Can a parent legally drug test a child at home without a court order during a custody battle?
A: You said that the prior judge directed the father to submit to a drug test but that the father failed / refused to submit to the test.

Now, there is a new judge assigned to the matter and you are fearful that the father will privately drug test your 18 month old child.

I presume that you are not fearful that the father will now submit to a drug test but instead submit your child to a drug test and I presume the concern is that your child will show evidence of drugs in his / her system and the father will attempt to blame you for the presence of the drugs.

Since the father refused to submit to the drug test when ordered to do so, what proofs would he have that any drugs in the child's system were caused by you?

The more important question is why didnt you enforce the order that required the father to submit to the drug test?

If the court ordered the testing and the father refused to comply, then you had the right to take action before the court for relief.

Similarly, if you were ordered to do something and the custody of your child is at stake, I would make sure that you are in complete compliance with the court's directives, regardless of whether ordered by the current judge or the prior judge especially if you want to point a finger at him for his noncompliance.
