Q. Hello, My mother filed the form i-130 form for me and its been approved but i am in USA on F1 visa. what do i do?
A: Your question requires too many questions on my part and too many answers on your part before I can even formulate recommendations as to the course(s) of action you should take. Consult with an immigration lawyer before taking any steps or filing anything.
Q. Do I submit the I865 form I have to the NVC that is over 2 years old or submit a new one with updated information?
A: If you do it will be rejected as stale. Always send a fresh I-864 Affidavit with a complete copy of your latest tax return, W-2 or 1099 forms, and a letter from your employer verifying your employment. I would urge you to consult with and hire an immigration lawyer to assist you with this case. Not because I think you’re not capable of handling it, you may will be, but in order for the lawyer to debrief and brief you, analyze, assess and evaluate your case in order to maximize the possibilities for a successful result.
Q. How long will it take to process an AOS (marriage-based) application at the Fort Smith office? From start to finish
A: Allow 8-10 months.
Q. I am a Daca recipient. I applied for food stamps for my daughter. Will that affect me?
A: You should send them a registered letter (make a copy) explaining their error and include a check for reimbursement. You will need this proof that you did pay them back. This will mitigate your situation when you apply for adjustment of status. I would urge you to consult with and hire an immigration lawyer to assist you with this case. Not because I think you’re not capable of handling it, you may will be, but in order for the lawyer to debrief and brief you, analyze, assess and evaluate your case in order to maximize the possibilities for a successful result. Also, your question requires too many questions on my part and too many answers on your part before I can even formulate recommendations as to the course(s) of action you should take for the future. Good luck to you.
Q. renew work permit here on assylum and married US citizen or adjust status or both?
A: First, I would urge you to consult with and hire an immigration lawyer to assist you with this case. Not because I think you’re not capable of handling it, you may will be, but in order for the lawyer to debrief and brief you, analyze, assess and evaluate your case in order to maximize the possibilities for a successful result. Your question requires too many questions on my part and too many answers on your part before I can even formulate recommendations as to the course(s) of action you should take. Initially, I would recommend renewing the asylum EAD as the adjustment of status may not happen. See an immigration lawyer.
Q. Adjustment of Status I-485 with arrest or criminal record and attorney fees
A: You should be concerned with hiring a criminal lawyer to obtain an appropriate disposition of your criminal case. Ideally, that would mean obtaining an outright dismissal of the charges. The disposition you are now seeking may avoid immigration consequences, assuming that you do not utter, sign, or enter a plea of guilty in any of the stages of the process. You should obtain court clerk certified copies of the arrest and final order of dismissal of the charges signed by the judge. I highly recommend that you hire an immigration lawyer to counsel you, prepare the forms for USCIS filing, and most importantly, attend the USCIS interview with you. Good luck to you.
Q. Where do I start
A: Your Q is unclear. Are your family members in US ICE custody and facing deportation proceedings?
Q. Can I marry an illegal immigrant if so what documents should we have
A: Your question requires too many questions on my part and too many answers on your part before I can even formulate recommendations as to the course(s) of action you should take. I would urge you to consult with and hire an immigration lawyer to assist you with this case. Not because I think you’re not capable of handling it, you may will be, but in order for the lawyer to debrief and brief you, analyze, assess and evaluate your case in order to maximize the possibilities for a successful result.
Q. My green card expired 04/01/2016, I just noticed. I am still married to my American wife, what do I do? I-75I form??
A: You and your wife can file joint I-751 petition with the required documents. You will also have to provide an affidavit explaining why you are filing late. Good luck to you.
