- Q. Impact of arresting officer's absence on drug and firearm possession charges proceedings.
- A: The State has the burden of proof beyond a reasonable doubt of proving each and every element of the bill of information---if the State is unable to do this without the arresting officer then yes his absence will impact the proceedings. Of course pre-trial motions are just that and the evidence presented at trial is the important part. There are many reasons a law enforcement officer may miss court so my recommendation if you have not already done so is to hire a lawyer to represent and advise you in your matter. Good luck.
- Q. How to place a share of an estate into a revocable trust?
- A: My opinion is that you have an asset of value (real estate meets this criteria) and you want do something with it as you have described: at a minimum you should have a meeting with an attorney to discuss the specifics and after said meeting you can determine if you want to proceed without an attorney representing you---this is too important for you to try to save money at this time---you want to make sure that what it done now is what you intend and that the actions you want to happen in the future will happen--if the paperwork is not done correctly, it may not.
- Q. How to execute a writ of seizure in Louisiana when told to file additional paperwork?
- A: Perhaps one would say it's self-preservation, but really the best advise/recommendation I can provide is that you consult with a collection/creditor lawyer about your specific situation and after said consultation you then decide whether or not to proceed with or without a lawyer. There are a lot of moving parts associated with collection proceedings and your failure to follow each part/step could jeopardize the entire process and perhaps require you to start over.
