- Q. What documents are needed for divorce with minors in Florida, requesting supervised visitation?
- A: You do not need those documents at the time of filing. Once the case is filed both parties will be required to exchange financial information. Regarding supervised timesharing, you will need to present evidence to the court that it is not in the children's best interest to be alone with the other parent. Gather whatever evidence that you believe exists to support that. Speak with a local family lawyer for more specific advice.
- Q. Divorce property division: House with VA loan and equity, no payment contribution from spouse.
- A: The short answer is yes, if you want to keep the house you will need to buy out his portion of the equity. Although the starting point is 50/50, you can try to make arguments that you should het more than half. - Q. Child support case petitioner seeks advice on final judgment after respondent default and hearing preparation.
- A: Unfortunately defaults on issues involving children do not carry much weight. You need to be prepared to present the parenting plan and timesharing that you want to exercise moving forward. Child support, administrative or otherwise, is based on each party's net income. Have an up to date financial affidavit at the hearing. Finally, try to communicate with the other parent.
