- Q. Mechanic error caused engine damage; repair delayed. Seeking legal advice.
- A: Absolutely, you should hire a lawyer, sooner rather than later.
You indicated that your damages are around $50,000.00. Of course, you will need to prove those damages at your trial on the matter. Your attorney can help you strategize the case and prepare appropriate evidence to prove up your damages. Your attorney can also help you evaluate the chances of collecting if you are granted a judgment against the mechanic.
- Q. Need legal recourse for unpaid work and embezzlement charges with neighbor.
- A: If there is a no-contact order against you, you must honor that order. That means you are going to need an attorney to bring any lawsuit against him to retrieve property you claim that he took.
I recommend that you make a list of each and every piece of property that he took, describing it with particularity and determining the current fair market value of each piece of property (not the cost of replacement). Your attorney will have to file a lawsuit in replevin to ask the court to order him to return the property to you. Your attorney will help you strategize and prepare your evidence and testimony. Your attorney will represent you at a trial on the matter.
- Q. Am I entitled to home equity in a divorce in Oklahoma after a 1-year marriage, with cash contributions for repairs?
- A: Since he owned the property prior to your marriage, and it is in his name only, you would have the burden to prove how much the home has increased in value due to your contributions during the marriage. Your investment receipts would be evidence to be presented to the court; however, the court is going to look at any improvements (not maintenance and repairs) to determine any increase in value.
Presenting your case could be complex. I recommend that you consult with an experienced divorce attorney to strategize presentation of your evidence at trial.
