Biography

Paul A. Schofield focuses his practice on helping those injured or wronged in cases involving trucking accidents, serious auto accidents, premises liability, pharmacy malpractice, medical malpractice, nursing home abuse, and wrongful death litigation. Paul also handles chapter 11 bankruptcy cases, helping businesses and individuals to reorganize their business affairs and return to profitability.

Since 2021, Paul has served as a chapter 7 trustee in the Brunswick and Waycross divisions of the Southern District of Georgia.

Paul has over a decade of experience helping clients with a wide range of issues, and believes strongly in client-focused litigation. He also believes in public service, having provided pro bono legal services to clients in conjunction with the Georgia Legal Services Program. Paul is a proud Kiwanian, having served as secretary of the Kiwanis Club of Brunswick since 2017.

Paul is admitted to practice law in all Georgia courts, the Supreme Court of Georgia, the Court of Appeals of Georgia, the United States District Court for the Southern District of Georgia, the United States Court of Appeals for the Eleventh Circuit, and the United States Tax Court. He is a graduate of Boston College and the Quinnipiac University School of Law (magna cum laude).

Q. Do I need a debt collection attorney?
A: You should speak with a bankruptcy attorney. In general, bankruptcy treats payments ordered through a divorce as one of two things - a domestic support obligation (child support or alimony) or a property settlement (basically everything else). In a chapter 7 bankruptcy case, neither can be discharged (eliminated). In a chapter 13 bankruptcy case, domestic support obligations cannot be discharged, but property settlements are dischargeable.

A bankruptcy attorney should be able to look at both your divorce decree and the court docket of your ex-husband's bankruptcy and be able to tell you whether you can collect on that debt and what your options are. Attempting to collect without knowing that information could mean that you are violating either the automatic stay or the bankruptcy discharge injunction, so make sure you get some advice that is specific to your situation. ... Q. Me and my husband filled Ch.7 bankruptcy and my husbands check is being garnished for a car that was discharged.
A: Unfortunately, there is usually no way to force a lender to repossess a vehicle. In most cases the lender has the option to NOT repossess the vehicle. However, it sounds like the lender in your case wants to take possession of the vehicle given that they told you they just could not find it. It might help to contact the lender (or have your bankruptcy attorney do so) to try and make arrangements to drop the vehicle off at a place of their choosing (such as at a tow company they work with) because, as Mr. Denison stated, the tow fees are a postpetition debt, so your husband will continue to be responsible for those fees.
