Q. Can creditors put a lien on my inherited house due to a past judgment, and should it be placed in a trust?
A: Your question touches consumer law, probate law, estate planning, and trust law. First question, whether the creditor can place a lien against the title to the house. The answer depends on several factors including how the howm was titled before your father passed away, who owns the home now, and whether the home is protected a homestead. LIkewise, the second answer depends on how the first question is answered. The information you provided does not lend itself to a straight forward answer in this forum. It may be worth your time to discuss your situation in more detail with an attorney who specializes in trusts and estates.
