Q. Is a realtor obligated to provide a signed document for an accepted bid?
A: Traditionally, you and the Seller will both sign what is called an "earnest money contract." It will contain the sales price you and the seller agreed upon as well as certain other terms. You will deposit a sum of money with a title company as earnest money (showing that you are "earnestly" interested in buying the property) and setting a closing date (typically in 30-45 days). During that time, the seller cannot sell the property to anyone else but can enter into back-up contracts in case yours falls though. That time is also designed to give you the opportunity to make arrangements to pay for the property either by freeing up your own funds or obtaining a purchase money loan. It also gives you and your lender the time to make any necessary inspections of the property and to review the title to ensure the Seller has good, clean, marketable title.

Normally, when all parties have signed the earnest money contract, your realtor will provide you with a copy, but that might take 7-10 days.

Q. Are the new company owners obligated to uphold my truck allowance agreement after a merger?
A: The parties almost always can modify a previous agreement if they both mutually agree to the modification. If the parties do not agree, it depends upon what the original agreement provides whether one party can unilaterally modify the agreement. If there is nothing that gives the company the right to modify the terms of the truck allowance agreement, then they cannot modify the terms without your agreement.

Be aware, however, that it is not uncommon for an employee agreement to specifically reserve the "at-will" nature of the employment relationship. "At-will" means that either party can terminate the employment relationship at any time for any reason except for those specifically prohibited by law (e.g. race, color, ethnicity, national origin, sex, age, pregnancy, disability, and religion). So, while the company may not be able to modify the terms of the truck allowance agreement, the company may be able to terminate your employment relationship entirely for not accepting the company's new proposed terms for truck allowance. But the company is bound by the old terms with respect to its obligations up to the termination of your employment. ... Read More
Q. Guidance on petition structure for fiduciary duty breach in TX.
A: Because you are filing suit as a fiduciary for your grandmother, you must hire an attorney under Texas law.

Unless a fiduciary is also a licensed attorney, filing a lawsuit pro se as a fiduciary constitutes the unauthorized practice of law and will not be allowed by the court.

A fiduciary can defend themselves pro se from a claim that they themselves did something wrong, but cannot prosecute a case pro se on behalf of the person to whom they owe a fiduciary duty.
