- Q. Based on previous question, is it okay that I have served insurance co. for small claims court first vs. mitagation co.?
- A: I would have sued both of them in the same case, and if they wanted to blame each other -- let them. They are both responsible for what happened. As far as you're concerned, it does not matter how you allocate the loss.
- Q. Who's at fault for not properly secure/protect appliances that were taken out kitchen after water burst?
- A: Both the mitigation company and the insurance company are responsible. The mitigation company because they should have known not to leave appliances wrapped in plastic in your backyard. Thus, they negligently caused the property damage. The insurance company has a duty under the insurance regulations to tell you about all applicable coverages. If a pack out was needed (which it was) your insurance company had a duty to advise you that it and the associated storage costs were covered. Also, viewed as a separate incident, the mitigation company causing you property damage should also be covered, although making a new claim would require that you pay a separate deductible.
- Q. My car was stolen and my insurance company has done nothing to settle my claim since 4/16/21
- A: I suspect there is more to the story, but basically you have probably have an insurance bad faith claim against the insurance company, not the agent. I would contact the adjuster and/or the adjuster's supervisor and find out why they have not settled your claim. Sometimes, the resolution of the claim depends upon you providing documentation and complying with a request for an examination under oath. If you have done everything you need to do, and the insurance company still will not pay, file a complaint with the California Department of Insurance. If that still does not get their attention, consider filing a lawsuit. If the value of the car is under $10,000, you might want to file it yourself in small claims court. If the insurance company owes you more than that, retain an attorney and file in Superior Court.
