Q. Seeking legal options for divorce and relocation with job offer
A: The jurisdictional requirement for divorce in the State of Tennessee is that it must be the state where you lived together the six months before your separation. I do not know what Texas law is on this subject, and you should contact a good divorce attorney about the requirement in Texas. With respect to the Complaint for divorce, you should hire a local attorney in your county. You have 30 days to answer the Complaint. If there are contested issues (usually involving children, property or alimony), then I would file a counterclaim with the Answer. The Court will charge you $100 for the counterclaim.

There is a 90 day period from the filing of the Complaint before you can conclude the divorce. If there are no children, there is a 60 day waiting period.

Seperate property is what you personally own. Marital property is property with joint ownership. It is not as simple as this statement, and in many cases, seperate property can become marital property. While seperate property is not divided, marital property is. In Tennessee, the division of marital property is equitably, not equally. This is with the discretion of the judge. You can have more impact on the final Order of Divorce by going through mediation. Alimony and child support are based on the circumstances and length of the divorce and the respective incomes. Fault may be a basis for a divorce. A divorce may be based on irreconcilable differences. In conclusion, if you need money, together than many other factors, do NOT just rely on this brief summary. It can be way more complicated. Hire a good, local divorce attorney.

Q. How can I address burn permit and reckless burning charges in court?
A: You have the right to an attorney. You have the right to not say anything incriminating against yourself. You just came on a public website, which is not good. You should wait for the hearing. At the preliminary hearing, the standard is Probable Cause. That is very easy for the District Attorney to wi. Your attorney will view the offers and work with you to see if they are satisfactory to you. You can be bound over to the grand jury and have a regular criminal case, where the standard is guilty beyond a reasonable doubt. Stop talking abut your case to anyone but the D.A.
Q. Can I apply for pretrial diversion for theft under $1000 in Tennessee?
A: You should be eligible for pre-trial diversion with misdemeanor theft. Google TBI diversion eligibility and pay $100 to get a diversion eligibility letter.
