- Q. Family member disputes driveway access after 30 years. What can I do?
- A: Unfortunately, if negotiation is not possible with this family member, you may be forced to file a quiet title action to prove the land is yours. You would likely receive an injunction at the outset so you could use your driveway in the meantime. Based on the longevity, I believe you have a prescriptive easement at worst, and you likely have title to the land via adverse possession. This situation could become complex, so I would seek counsel ASAP.
- Q. What legal options are there for a 7-month delay in changing resignation to termination as per settlement agreement?
- A: Without reading the agreement for myself, I cannot give you much advice about your particular issue, but it sounds like you may have a breach of contract claim on your hands. The be successful, the breach must be material and you must have completed your end of the bargain. Additionally, you may be able to show damages if you can prove you were not hired because of this breach. I believe you should consult with a contract-specific attorney to assess your legal options.
- Q. Will dismissal of order of protection affect related charges in TN?
- A: The criminal charge and the OP are two separate actions. They do not directly affect each other. A dismissal in the OP, however, can still be useful. If it was dismissed as the result of a trial, the credibility of your accuser could be questioned. In turn, this fact could be used by your attorney as leverage in plea negotiations. That being said, you need an attorney. You should not handle this complex situation alone.
