6 Questions Answered
- Q. We were told we have a strong case against a cruise line. Not sure how to proceed.
- A: The best thing you can do is contact an experienced maritime lawyer. Depending on the cruise line, you are required to file any case in a specific location. The vast majority of cruise lines cases must be filed in Miami, Florida (Carnival, Royal, NCL). Princess cases have to be filed in California and Holland America cases have to be filed in Washington State. Feel free to email me directly at mw@lipcon.com and i'm happy to give my advice directly.
- Q. Cruise ship injury from wind tunnel effect in stateroom.
- A: We’ve handled dozens of injury cases on cruise ships involving the wind tunnel effect just like yours. As such the cruise line is on notice of the danger. Feel free to email me at mw@lipcon.com and we can likely help. Note that any case has to be filed in miami within one year of the injury per the terms of the cruise ticket contract
- Q. Is the Death On The High Seas Act a claim a family member can file in addition to a wrongful death claim, or instead of
- A: They are practically the same thing. If a death occurs on the high seas you must file a lawsuit under the death on the high seas act. There are very few exceptions to this.
