- Q. How to sue police for failing to protect and serve after bar assault incident in NM?
- A: To pursue a lawsuit against the government here, you should consult with an attorney about the details as soon as possible. This is because there are some deadlines in New Mexico to file a notice of intent to sue: 90 days Tort Claims Act, 1 year Civil Rights Act. This is aside from the statute of limitations. There can be difficult issues of immunity in the federal courts which would be navigated if the Federal Laws are used for the suit.
It can also be difficult to sue if your wife pleads guilty. You will want to consult with a criminal defense attorney too.
Hopefully, if you can demonstrate that she was arrested without probable cause, you may be able to get justice. Best wishes!
- Q. Prevent jail after missed arraignment and bench warrant in NM.
- A: Hello, I am sorry you are dealing with this. However, you need to contact an attorney as soon as possible so that person can file a motion to cancel bench warrant and allow for a voluntary appearance. There may be additional issues here like a failure to advice you of a grand jury hearing through a target letter. Obviously, you need to build your defense as well. The public defender can do this, but if they are overburdened which does happen, you will need to retain a private attorney. This is my area of expertise so I would be interested. Good luck to you.

- A: This is extremely concerning. Corrections department providers of medical treatment are notoriously slow to give care and have been known to delay treatment incorrectly.
