Biography

Mason Rashtian is an accomplished trial attorney and the founder of The Mason Law Firm. After graduating from law school and passing the California Bar Exam in 1997, Mason began his career working for prestigious law firms across Los Angeles and Orange Counties, where he represented insurance companies and defendants as a litigation attorney.

This experience on the defense side gave him invaluable insight into how insurance companies approach and defend claims — knowledge he now uses to his clients’ advantage. In 2006, Mason opened his own practice dedicated exclusively to representing injured individuals and their families.

With decades of litigation experience, Mason brings a unique and strategic perspective to every case. Q. Can I demand compensation for injuries from a neighbor's dog attack in California?
A: I am sorry to hear about your injuries. California is a strict liability state when it comes to animal attacks. This means that your neighbor is presumed to be at fault and responsible for any injuries caused by their dog.

So, yes. You have a case against your neighbor, and if your neighbor owns the residence and has homeowner's insurance, that should cover this incident. However, that being said, some insurance policies exclude certain dogs, such as pit bulls or Rottweilers.

You should contact a Personal Injury attorney familiar with dog bites. They should be able to guide you through the process and assist you with your case.

Therefore, it is necessary for the shelter to be aware of any prior criminal activity on its premises or to be notified that one of its guests, patrons, or visitors may pose a danger to others.

The best argument here is that the shelter was aware that someone on its premises was carrying a weapon, and threatening others with that weapon. If the shelter failed to take action, such as removing the individual and contacting law enforcement, then an argument can be made that it breached its duty to keep you and others.

Under this set of facts, the shelter may be responsible under a negligence cause of action, and if proven, they can be responsible for your injuries, medical bills, and pain and suffering. The best course of action is to contact a personal injury attorney and explain the facts. An experienced attorney should guide you and may need to file an action to determine the viability of your case.
