Loyd J. Bourgeois is a personal injury attorney and founder of the Louisiana-based law firm, Loyd J Bourgeois Injury & Accident Lawyer. Originally trained as an engineer, Loyd left a successful corporate career to pursue a legal degree from Tulane University School of Law, graduating cum laude. - A: You are not legally required to hand over your entire past medical history to an insurance adjuster. However, they will almost always ask for it because they want to find anything in your past they can use to argue that your current injuries were “pre-existing” or not related to the incident.
Slip and fall cases in general are already typically harder to prove than other personal injury cases like car crashes. I would not advise signing a medical release or letting the adjuster request your records without first discussing with a personal injury lawyer. Your lawyer will usually collect the necessary records, review them, and then send the relevant records to the adjuster.
- Q. Friend abandoned after car accident en route to Louisiana; legal actions?
- A: Since the crash happened in Mississippi, your friend will need to speak with a personal injury lawyer who is licensed in Mississippi. There may be potential claims against both the driver and the company that hired him, depending on the facts and contracts involved.
Because the incident was about two years ago, time is critical. Mississippi has a statute of limitations that usually gives injury victims three years from the date of the accident to file a lawsuit. Waiting any longer could mean losing the right to bring a claim. Beyond that, the longer the delay, the harder it becomes to gather evidence, locate witnesses, and build a strong case.

- Q. Could I go to jail for a car accident without insurance in Louisiana?
- A: Unlikely you will face jail time for this. While I am not a criminal lawyer, I have helped clients without vehicle insurance in the past and none have gone to jail solely for lack of vehicle insurance. If you are hurt, you should speak to an attorney however. While you may not have had insurance, the at-fault party driving your vehicle may have been covered by their own insurance.
