5 Questions Answered

Q. If I file bankruptcy will they take my house and vehicles? I owe 14000 in credit card debt
A: Typically no. As long as you keep paying for your home and cars, you can keep them. Its important to find a bankruptcy attorney in your area that can help you
Q. On a ch 7 or 13 means test: can voluntary IRA deductions of non-filing spouse be applied as a marital adjustment?
A: That depends on a couple of factors. How much, and when they started contributing. Let me know if you still have questions.
Q. Can changes be made to my Loan Modification Agreement if I became unemployed in the process?
A: That is a tough one. It is true that you can qualify for a modification once every 12 months, HOWEVER, if there is a change is circumstances, then you could always apply again. I would call the bank and find out what your options are. If you still need help, feel free to call me.
Q. Can I list an expected tax check under assets to prevent it from being intercepted when filing ch.7 bankruptcy?
A: Yes you can. Depending on your state exemptions, you can exempt any anticipated tax returns. I would call a local attorney to help you through the process and make sure that is the case for your district.
Q. I filled bankruptcy on my second Line of mortgage but I still payed it now the interest has gone up and I can't pay
A: If you filed bankruptcy and you included your 2nd MTG in it, then you are not financially obligated to pay it. However, this can impact your home. You should call your bankruptcy attorney to help you.
