Kenneth graduated from Ohio Northern University in 1996 with a Bachelor of Arts degree in Political Science and History. While at Ohio Northern, Ken was a member of three honor societies and two national mock trial teams. He then entered Ohio Northern University Law School and graduated in 1999 with a Juris Doctor degree. After law school, Mr. Sheppard earned his LL.M. (Master's Degree) in Taxation from the University of Denver in 2000.
Attorney Sheppard is admitted to practice law in Ohio. He is also licensed in U.S. Tax Court as well as both U.S. District Courts of Ohio (Northern and Southern). He is a member of the Ohio State Bar Association, Credit Education Coalition and Better Business Bureau.
Prior to opening Sheppard Law Offices, Kenneth was the Director of Advanced Planning for a prestigious national wealth management firm. Mr. Sheppard opened his law practice in 2005. Ken's law practice is concentrated primarily in the areas of bankruptcy, divorce, probate, estate planning, and taxation. Mr. Sheppard has handled many Chapter 7 and 13 consumer bankruptcy cases, providing financial relief to individuals and small business owners in central Ohio. Throughout the entire state of Ohio and across the country, Mr. Sheppard has helped his tax clients resolve their federal and state income, employment, and sales tax problems.

- Q. What happens to credit card debt in Ohio when a deceased is solely responsible?
- A: Assuming she is single and all of the credit card debt is in her sole name, then only a probate asset can be used to pay off that debt. If there is no probate assets, then her estate will not have to pay back that credit card debt. The house is in survivorship status therefore it is not a probate asset upon her death. The home mortgage still has to be paid once she passes away as that is a secured debt which the lender has a secured interest in.
- Q. Will I lose my home and car in Ohio if I file for Chapter 7 bankruptcy?
- A: Based upon these facts, the trustee would look to sell your home and car. The exemptions allowed in Ohio do not cover the equity in these assets. The non-exempt equity is quite large and therefore a chapter 7 trustee would look to sell your assets. Chapter 13 would be your alternative. In a Chapter 13, you keep your assets; you just have to pay your unsecured creditors an amount they would have been entitled to if you had filed a Chapter 7 bankruptcy... this is called the best interest rule.

- A: If your question pertains to suing or accusing H&R Block for negligence, yes, there are lawyers out there who may take on that matter on your behalf. To the degree of success in such a case is questionable. You are still ultimately responsible for what is on your tax return. If your question pertains to resolving the issues you have with the taxing authorities, yes, there are lawyers who can help. Some tax lawyers handle specifically this type of work.
