Jason Horst is the Managing Partner of Horst Legal Counsel. Jason served for more than a decade as an attorney in large regional and international law firms before founding Horst Legal Counsel, serving the legal needs of businesses and individuals in California.

2 Questions Answered
Q. Can any lawyer within a firm issue a deposition subpoena or only the attorney on record (listed on the court register)?
A: Generally, any attorney in the firm of record can issue a subpoena. It is not unusual, especially with larger firms, for attorneys whose names do not appear on the court’s list of counsel to work on a matter and send out correspondence and discovery requests, including third party subpoenas.
Q. How do I know a summons is legit and not a scare tactic from the other party’s attorney?
A: See if there is a file stamp in the box at the top right. If so, the complaint and summons have been filed and it’s a real lawsuit. Doesn’t necessarily mean the other side wants to take the case all the way to trial, but it certainly suggests that they are serious about pursuing the litigation.
