- Q. Arrested under mistaken identity; seek legal guidance.
- A: You need a criminal lawyer first and a civil lawyer for any civil suit. Just because you did not live in the State to the Police or Prosecutors mean nothing as you could have travelled to NJ to commit the crime and you will have to prove you were not in NJ (yes the law says otherwise, but lets look at reality not the text book) The defense you raise as to birth date and social security number are of course more relevant. Get yourself a good lawyer that is the only thing you can do to recitfy this unfortunate situation you are in. Remember the better the lawyer you hire, the better your chances are of getting out of this with a good result.

- A: You are facing up to 30 days in jail and a 6 months mandatory loss of license if you are convicted of leaving the scene of an accident in NJ. I thus must suggest that you hire a good lawyer. Unfortunately, in NJ a presumption exists that if you damage a vehicle with $250.00 or more worth of damage that you are presumed to have knowledge that you were in an accident. Obviously, being in your car with the windows closed and only damaging the mirror of another vehicle could have meant that you never heard or felt anything. - A: The answer really depends on the statute number she is charged with, which you have not provided but she could be looking at up to 60 days in Jail and 6 months loss of her license. Make sure she gets a good lawyer she needs one, this is not a type of case you should try to help yourself on as the consequences can be severe. Most of us traffic ticket lawyers offer a free in office consultation. I would suggest that you set one up.
