- Q. How can I trademark my personal name for doula services?
- A: You can trademark your business logo to protect your trademark and business. To do this you must file a trademark application with the USPTO. If your mark is already in-use you can file a In-Use application, otherwise you can file an intent to use application. It is recommended to work with a trademark attorney to assist with guiding you through the USPTO and Trademark Application process.
- Q. Trademark expiration and renewal duration in the U.S.
- A: A Trademark in the US must be renewed between the 5th and 6th year of registration by filing a Section 8 renewal. The mark must also be renewed on the 10th anniversary by filing a Section 8 & 9 with the USPTO. Thereafter, you must renew your mark every 10 years. Failure to file a timely renewal in the US will cause the mark to be abandoned.
- Q. I see Loom & Love is registered as a trademark. I started a small clothing llc with the same name, should i be worried?
- A: When registering a trademark it is best practice to work with a trademark attorney to conduct a search and guide you through the trademark registration process. At first glance there are many dead registered marks for the words "Loom &Love." However, you must also search other common businesses such as google and amazon to see if another company is also already using the name. It is best to consult an attorney to find out if the name is in use and you should apply for the trademark to confirm your ownership.
