Biography

Donald I. McClellan joined Basler Family Law in July 2021. Donny effectively advocates for his clients by finding creative solutions to achieve client goals. He helps clients work through difficult and stressful situations so they can focus on building the life they want for themselves and their loved ones after the case is over. The long-term is often difficult to see in domestic relation cases, particularly when the case is high conflict. Mr. McClellan knows that ultimately moving past the anger and pain to focus on what is truly important leads to greater happiness for those going through what is likely the hardest event in their lives, and he takes great pride in helping clients find that happiness.

Mr. McClellan began practicing at the Family Law Clinic when he was still in law school. After graduation, he scored in the top 2% in the nation on the Multistate Bar Exam, then clerked for the Honorable Thomas R. French on the family law docket in Colorado’s 8th Judicial District. He then entered private practice and his experience in family law led him to Basler Family Law, PLLC, which has a reputation for professionalism and zealous advocacy.

Mr. McClellan offers bundled and unbundled services in all areas of family law, including prenuptial agreements, divorces, child support and maintenance issues, relocation, parenting plan modifications, and parenting plan enforcement. Q. Is about divorce and how it works in the state of Colorado if you have properties, 401k, and a small business.
A: All marital property must be equitably divided in a divorce (not equally, equitably). Marital property is anything obtained on or after the date of marriage, and the increase in value of property since the date of marriage. It does not matter whose name is on title. So if you owned a house before the marriage, the increase in value since the date of marriage is marital property, even if only your name is on title. Marital property can include real estate, retirement accounts, and ownership interests in businesses. It will also include debts obtained on or after the date of marriage, and the increase in value of debts since the date of marriage. The business can be valued by an expert, or the two of you can agree on a value. You will go to mediation to determine how to divide the marital property and if no agreement is reached on one or all issues, then you will have a hearing and the court will determine how to equitably divide the marital property. ...
